Question:

We were evicted for diisscriminatory reasons,and had no lawyer .now homeless.help?

we-(my 17yr daughter,and 5month old grndson,myself 51 and hus.44.)werw evicted because housing authority did not want my husband there because he had a past crim.record. (nothing major--and nothing for over 2 yrs. last was arrested for a D.W.I paper mixup from 5 yrs ago. he is great man,and did absolutely nothing .but when i married him last may,they gave us notice to quit possesion.we called lawyer--she told us to put rent in esscroll,and bring matter to trial. we did.. but then they got us for non payment of rent..lawyer wouldnt help us ..we went to trial..had all rent..but no one to represent us.we lost . my daughter n grandson had to go stay with other family..huh n i are staying with older daughter,but (cant stay here).my hub..is dissabled,and we did (nothing wrong) I lost everything.

  2. Did you not have a lawyer because you could not afford one? Because  a lawyer will look at your case and tell you if you really have a good case, if not he wont take it. If the lawyer did not take it then there is more to the story that is being presented very vaguely, or its just a weak case.

    If you DO have a case and a strong one such as the one your saying about Discriminatory some lawyers will work out arrangements to where they'll take the case and take a percentage of the money.

    My dad is currently in a lawsuit himself and he does not pay a lawyer hourly and whatnot, but the lawyer IS getting about 35% of the outcome.

    So if its a GOOD and STRONG case then you can find a lawyer because money is practically guaranteed for him.

    If you have a weak case start looking into housing with friends, family, salvation army....etc

  3. i was put out for retalitory eviction. complained about an apartment complex to the department of health. retalitory evicion is against the law. most free public law firms have housing lawyers. contact the mayor in your city and ask where the free law firms are for the "needy".

  5. they should always be a public lawayer even though they may not be good but if the case is really good another law firm will take your case for free

  7. go to a law office you find in the phone book and tell them.  They  might be willing to help you pro-bono.

  11. That doesn't make any sense...so they evicted you for what specific reason?

    Typically if you are paying rent and have no history of missed payments and there building management is constant there is no reason to evict you.  

    However if you were doing something illegal, causing problems & not paying on time they may have had a legal right to evict you.  

    Also for them to evict you if you were paying rent you would have recieved notice so you could arrange for a new domicile, typically 30-60 days.

    Keep in mind i'm not a lawyer and laws may vary by state, but this seems more like a complaint than an actual question.

Was your rent paid?  Were any other reasons given for eviction?  Why didn't you go to Legal Aide in your area and fight it?  We need to know more about the situation.  In the meantime, go to your local social service agency and see if they can help you or try a shelter, I am so sorry.  This justn't seem to be right.

    If you were evicted illegally, then you would be entitled to triple damages or 3 times your rent.  Did you respond to the eviction notice  when it was presented to you?  Did you get a court notice?  Sis you go to court?  Did you comply with the reasons?  Was your tenancy month to month or annually?

    Did they evict you before they were supposed to or lock you out before the hearing?

  17. find a homeless shelter that takes families or a mission. i'm assuming you are at a friends house or a library. find the number to the state attorney generals office and ask them to mail you a complaint form (to a friends house or something) file a complaint against the person who evicted you. a homeless shelter should be able to help you get some nice clothes and find a job. keep it. save all your money that you can. seems like when you are broke, it's much harder to save since you need so much. but don't buy anything that you don't need to live. go to the nearest restraunt and ask if you can wash dishes, anything to make a little money. tell them you need to feed your kids, you are in a bad situation, and you will be the best employee they ever had. if you have to, if you can, leave your kids with a realtive or friend while you get on your feet. have you filed your taxes? if you have kids, you should get some money back. find the nearest tax place and after you file, ask them to keep the check in the office for you to pick up. i wish i had better suggestions for you. i wish i could do more to help you.
