I was in a car accident and my insurance company gave me a check for diminished value. but on the check it has my name as well as Nissan motors on it. so now what do i do next?

  1. You need to contact your lienholder to discuss this with them.  They may be entitled to the proceeds since they technically own the vehicle.  

    You can also try going third party against the other driver if they were at fault.  The check would be in your name only, unless you live in TX.


  2. Pay off the loan to Nissan....if you own the car bring the title to your agent....he will clear it up.

  3. since there is a lein on the auto the insurance MUST make the check payable to both parties.  you will need to contact Nissan (leinholder) to have the check endorsed so you can cash it.  this is because they have an interest (the loan) in the auto.
