What's the best way to get my name off month to month lease while someone is living there

I moved out to a new place a few months back. My ex stayed at my old place under my name (we agreed this would be temp.) Now he refuses to move out and on top of that he's moved another one of his friends in. Things are getting very hostile between us two and I've told him for two months now that I want him to move out, but he refuses, it's a month to month lease can I just contact the landlord and have them end the tenancy. He was never listed on the lease,I feel I shouldnt have to pay to evict him, because I don't live there anymore. Also could I get in trouble for the fact that he's living there and landlord didn't know?

Yes, you can contact the landlord and give 30 days written notice of termination of the lease -- that's what a month to month lease it about, you can end it at any time.  Also give your ex the same 30 days written notice that the lease is ending and he will be evicted if not out in that time.  Then the lease will be over and your ex can be legally evicted.


  2. If you are month to month, simply advise the landlord that your tenancy ends in thirty days.  You might advise the landlord of the situation, since you MIGHT be held liable for damages your ex causes, as well as eviction expenses.

    You will need to check your lease to determine what sort of arrangement you were in.

    You let them move in under your name. You are going to have to evict them. They are your month to month tenants.

    They are now your tenants (month to month sublease) - they have no agreement with the landlord, only with you. You are responsible for them, the rent, any damages and any costs the landlord incurs to evict them.

    The other option is you give notice, they fail to move out, the landlord files for an eviction and names you because you are the legal tenant. They are your occupants, you move out, you can't leave them behind for the landlord to deal with without any consequences. You cannot legally terminate your tenancy while they are still living on the apartment.

The thing is you could lose some of your security deposit if they have to pay people to remove all of the things in the apartment. Don't take his sh*t though. Tell him he has to move out or he's going to be removed by the police. IF HE'S NOT EVEN ON THE LEASE YOU CAN CALL THE POLICE AT ANY TIME AND HAVE HIM REMOVED. BE THERE WITH THE POLICE TO ENSURE HE DOESN'T WRECK THE APARTMENT OUT OF HATE

    dude, i hate to be in your shoes, he could trash the place or stop paying rent and you could be one of the people they come after.
