What's the most hassle-free way to make a joint mortgage/deed single?

A few years ago my bf and I bought a house together. (I know, I know - mistake). Now he's moving on (and out). I want to and can afford to stay in the house alone. Do I have to refinance the mortgage to get him off of the mortgage and the deed? This is in Massachusetts.

  1. You can do a quitclaim deed. When he signs it, it expunges any right and responsibility to the property. It's the easiest way to remove someone, or for someone to decide to remove themselves from obligation to a property.

  2. I can't speak for Massachusetts, but if he's in agreement you can normally modify the deed with your county clerk for a small fee.  I don't know the name of the form, but if you talk to your clerk they will know.

    Sometimes it's necessary to get a real estate attorney to do this for you, but it's a simple process and shouldn't be expensive.

    Of course, if he's not willing, or if he's on the mortgage to the house, it's a whole different story and will likely be expensive, difficult and/or impossible.
