What Can I Do To Get The Minimum Penalty For Underage Consumption?

Hi, im from ohio, my problem is myself and two friends were drinking and went and sat in my friends car with the a/c on and listening to some music and a cop came up and breath tested us. He wrote us all citations we didnt get arrested he said we were calm and he was doing us a favor esp not givin the kid in the drivers seat dui. He said that it wouldnt be a fine of more then like 250 and we would have to go to classes. He said he was sending us to mayors court cuz they r easier. I dont believe a word he said, anyone know where my friends and i stand punishment wise? should i get a lawyer? help please

What is a diversion that seems to be a popular answer ive seen and how would i go about finding this out?

Dont drink out in public if youre underage. Do it in your house

What were his grounds to come up to the car? Currently it sounds like he over stepped his bounds. Was it in a residential area, i.e. driveway or were you in a public area like a parking lot? If you were in a residential area and legitimately parked, it sounds like he would have had no grounds to search/breath test. He had no probably cause to suspect anything was going on unless you were behaving poorly. Now, if you were on private property not of your own he would have a reason to determine the cause/reason of your action. Unless you were doing something stupid or on private property he had no probable cause in speaking with you. Get a lawyer and tell him everything. From reading just this, it sounds like he knew an arrest for a dui or public mischief wouldn't hold up in criminal court so he wrote you a citation.  Good luck.

EDIT: Okay in that situation, was the noise complaint filed on an apartment or a car? Do you have aftermarket subwoofers/amplifiers or anything that could make an incredible amount of noise? Were you outside before 11Pm because usually noise ordinances start at 11pm and if it was before that he couldn't do anything. How did he know it was YOUR car? Were your windows rolled up?

aw bud no worries ive had 2 M.I.P's (one while i was driving (empty Yeager bottle in backseat) and it wasnt that bad ask for a defered judgement and 1 year unsupervised probation, write the judge a letter telling him why underage drinking could hurt yourself and others and what you are doing to "turn your life around" please dont stress!! itll be OK  (i just was looking at 30yrs in jail for 5 felony charges and i got off with a defered misdeminor harrassment) just show the judge your a good person that fell into a bad time or bad crowd oh and WEAR NICE CLOTHES! A SUIT PREFERABLY! (but make sure tou stay outta trouble man im tellin you jail is NO PLACE yo wana end up it sucks imagine 30 pissed off inmates fighing over what to watch on a 9" tv (3 channel changes a day)
