What I meant was - can the immigration (european economic area) regulation 2006 be retrospective to 2004?

A case of divorce in 2004 now covered by Regulation 2006, with respect to being married for a minimum of 3 years. Can ths apply to a divorce in 2004 which lasted for over 3 years. Pls help me out here guys.

  1. No, this law only applies to divorces after April 2007. So if you are married to an EEA national for at least 3 years, were living together for at least one year and get divorced after April 2007 you can apply for Indefinite Leave to Remain.

    Anyone who got divorced before April 2007 unfortunately cannot benefit from this law.
