What Would You Have Done If Your Friend Had You Living In An Apartment That Their Dog Relieved Itself In?

My son & daughter shared an apt. with my daughter's friend. Only my daughter's friend signed the lease (daughter was too young & son moved in 6 wks. later). My daughter's friend decided to bring her dog to the apt. & from the very first day the Yorkie piddle & pooped continually! My daughter's friend, Haley, never walked this poor dog & whenever she went away for a weekend she would ask my kids to care for it. They felt sorry for the dog & cared for it the best they could. All the while, Haley never would clean or pick up after herself. Whenever my kids would have a friend come over to hang out, my kids cleaned up everything including ALL and ANY messes Haley had left. Also, my son's friend stepped in dog c**p & was upset so my son was very embarrassed. She even had the nerve to go to my daughter's room one morning & say that she didn't have any clean bowl or spoon to have cereal with! In April my son told Haley that if she didn't clean up & follow the cleaning schedule that they had ALL agreed to & to get the carpets shampooed because the odor was so sickening then he would move out. Haley never did change so my son moved out. Now, Haley is mad & had her parents come up & move her out claiming that my daughter & son were "unfair to HER"! The lease is not up until Sept. 30th. The leasing office told my kids that they are in no way responsible for the rent or clean up of the apartment. Haley & her mother have been running their mouths off sounding as though my kids jumped ship & did Haley wrong. What do you think? I say that living in a place thick with dog urine & f***s is unhealthy & that my kids have done what they needed to do for the sake of their health & sanity! Can my kids take Haley to small claims court to try to get back the rent they paid since they were stuck until they couldn't stand it anymore? We live in Indiana. Please give me your input.

  2. I agree with you as property manager and as a human being. Who cares what the other mother thinks? I'd laugh it off.  

  3. If your kids didn't sign any lease then they are in the clear, they can move out at any time and are not responsible for the rent in anyway.

You already answered your own question.  The leasing office told you they are not responsible.  The only way they would be responsible for the rent is if they stay there.  Your son moved out but did your daughter?  If not, she needs to move.  Otherwise, she will be held for future rents and any cleaning as of the next rental period.  

    But as they stayed there and voluntarily paid rent, NO, they cannot sue Haley and get their rent back.  Be very glad the landlord is not holding them responsible (as long as BOTH are moved out), because they lived there (with or without the landlords permission)  he CAN hold them responsible.
