If you as an employee get fired for incompetence would you still be eligible for state unemployment benefits? This can be for any state or if you know about Minnesota's unemployment benefits you can answer too.

  1. Yes.  Unemployment is an insurance employers pay into so that fired and laid off employees can receive income while looking for a new job.  It is mandatory that they contribute.

    Please file right away, there is a waiting period that does not begin until you apply.  In some states they automatically deny benefits so if that happens to you, appeal the denial.


  2. Most likely, yes.

    In the case of more serious negligence or something, the employer may choose to fight it, but the majority of the time they won't bother.
