Question:

What action can i take when paypal violates it's own dispute rules?

After 8 weeks, paypal finally closed a dispute against me (the seller). I provided valid tracking information, sent numerous emails to a very rude and stupid client who clearly had the item but claimed on it anyway. I provided international proof of postage, and royal mail states that it attempted delivery. Paypal have awarded my cash to this buyer WHO ALSO HAS MY ITEM so what can i do about it?!

Paypal held the money from my account AND automatically sent her a payment when it was closed. Its only about £30 that i'm moaning about, but they not only held it, they ALSO sent it once it was done. I had 30 removed to start with 2 months ago and have now had a further 30 deducted from my bank account.

It's unfair as i KNOW she recieved it (nothing goes missing recorded) and depite having this proof, paypal gave the money back. i am annoyed mainly out of principal. SHE NOW HAS DOUBLE HER MONEY AND TWO LOVELY HANDMADE ITEMS. GRR

WHAT CAN I DO?!

  1. PayPal's only concern is whether the item was delivered (and not that delivery was attempted).

If online tracking doesn't actually show that the item was delivered, they will almost always come down on the side of the buyer.

You can try emailing PP to explain things but you probably won't get any more joy than you've already had.

You can also lodge a complaint against them - log into your PP account, use the Help link, then Contact Customer Service, then File a Complaint in the European Union and Complain about Payal.  You can then enter some details.

Some info on the official complaint process here

('Tracked' - ie, Recorded, Special, Int Signed For, Airsure - items can and do go missing in the post.  If that is what happened, you can claim against Royal Mail.  Ask in your local Post Office if you need more info on that.)

  2. Take on Paypal?  Good luck, they are like the Tax man, Judge and Jury rolled into one. You can argue with them until you are blue in the face and all you will get back is 'form' letters.

I  hope though that you will not mind if i say that you are making some assumptions about both the seller and the security od Recorded Delivery. I have had recorded delivery packages left on my door before now unsigned for, and many times a neighbour has taken one in and signed for it.
