What are my chances for custody

This total jerk and I had a beautiful child out of wedlock. He took him from me 2 years ago. (not legally) Anyway the father is in alot of legal trouble (felony charges and back child support) from another child he had. And he has yet another baby coming in september. (3 kids total) And he is not with any of the childrens mothers. I want my child. I have come along way in the last 2 years. I have straightened up my life- gotten married- and have recently bought a home. My Ex and my son have lived with 3 different women in the past 2 years. He has picked up his 2nd DUI and continues to loose his job due to bad UA's.

Well I'm surprised either one of you still have rights to the child I mean come on your his mom and you didn't fight it to get him back 2 years ago?

Who knows what your chances are, it's really hard to say without both sides of the story.  Just get a good lawyer to help you.   It sounds like 2 years have passed and he still has your child????  why haven't your fought for your child??   Just because he gets in trouble with the law doesn't make him an unfit parent (not that he isn't a jerk for not paying his child support).  You may be able to get joint custody.  No on could really tell you on here.

If your story is close to what a judge would believe, your chance is excellent. The judge decides what is best for the child. If the jerk goes to prison, Child Protective Services would probably contact you immediately anyway to see if you are a qualified parent. Call a lawyer who specializes in child custody cases and ask how to get started.
