What are my consequences and what will i pay if i went 19 mph over speed limit while having four passengers on

provisional license. im in southern california i know i will have to pay about 300 for the ticket and traffic school but they cited me for transferring 4 passengers. im only worried about the passengers part because its provisional and it went against the provisional license what will happen?!?!

  1. first, on the back of the ticket you have a optinion to do a trial by written declaration,,,,this allows you to write a letter stating your side of the story,,,,then you mail it to the judge,,,if the officer doesnt write a letter you win....if you don't win this round you still can go to traffic school or fight it in person.....tips on getting out of a ticket chceck the facts carefully make sure the officer put your write date of birth etc..one mistake and you win you just have to point this out...


  2. OK... as far as the fines...  it would be helpful to know what exact vehicle code sections you were cited for... but I'll make some assumptions based on your description...

    I'll assume that the speed violation was 22350 CVC.  If so, the fine for this violation (including court fees) should be about $266.  This is a 1 point violation

    I'll assume that the provisional license violation was 12814.6(b)(1) CVC.  The fine/court fees for this violation should be $146.  Instead of a fine, the court has the option of giving you 16 hours of community service.  This violation does not create any points on your driving record.

    As far as "what will happen."  You need to follow the instructions on the citation regarding when and where to appear for court.  Normally, you will receive a "courtesy notice" from the court prior to your appearance date which explains the process and your options.

    When you appear, you will normally be given the option to plead guilty (and pay the ticket) or appear in court and fight the ticket.  Sometimes you will be given the option of traffic school (the courtesy notice should say whether this is an option).

    If you choose to plead guilty or you are found guilty when you appear in court, you will be required to pay the fines (listed above) and will be assessed a "point" on your license.  DMV will also send you a warning letter.  You can also expect your insurance rates to go up.

    If, within 12 months of this conviction, you receive another conviction (or "point") on your driving record, your driving license will be restricted to driving only with a parent or licensed adult over 25 for a period of 30 days.  You will also be placed on probation for 1 year.

    If during your probation, you receive a another point on your driving record, your license will be suspended for 6 months.  When you get your license back, your 12 month probation starts over again.

    If traffic school is an option and you elect to do that, you will have to pay the fine/court fees listed above in addition to an additional traffic school fee (not sure what it is currently).  You'll have to complete the traffic school class and submit proof of completion to the court by a certain date.  Assuming you do all that, you will not receive a point on your license (or a warning letter, etc.).

    If you appear in court and are found "not guilty" for both violations, then nothing happens.  You do not pay any of the fines, and you don't get any points on your record.  The ticket just "goes away."

    If you choose to ignore the ticket and not show up to court, your license will automatically be suspended until you appear in court.  Additionally, you'll be charged with 40508(a) CVC which carries an additional $146 fine.  You'll have to take care of all the fines before your license gets reinstated.

  3. I would not worry about the price of the ticket.  In southern cali, wait to see what happens to the price of your insurance.  My friend got a ticket for 22 miles an hour on the 15 frwy outside of Baker.  His insurance went from $1200/yr to almost $2000/yr.
