What are my legal responsibilities> regarding my 20 yr old son's robbery arrest?

My 20 year old son, who does not live with me, just got arrested for robbery. Am I going to be held liable for his legal defense?

  1. legal age for what?  Adulthood?  If he's not considered an adult, then you may be held responsible for the costs of his defense, fines and fees, and victim restitution.  If a person in NY becomes an "adult" at age 18, as in most other states, but cannot legally drink or gamble until age 21, then he's an adult and you're not liable for any of those costs.


  2. Usually at 18 the child is emancipated, unless living and going to school, or mentally incompetent, to live alone and in need of support from family.

    Since none of the above seem to apply, "NO."

    A Public Defender, or legal representative, will represent your son, if he does not have an attorney, one will be appointed for him by the court.

  3. 18 is considered adult. Your not liable for him.

  4. you do not have any responsibility for your son's legal issues at the age of 20.  it is up to him to either secure the money for a private attorney, or to allow the court to appoint one for him.  in either case, it is his decision.  you are only liable for his legal defense if you choose to involve yourself.  so, if i were you, i would let him learn on his own and suffer whatever consequences come his way.  let him stick it out with a public defender.

    once he turned 18 he's responsible for all his legal matters.

  6. In all states, per your Miranda Rights, (you have the right to remain silent, you have the right to have counsel present for any questioning....") you have the right to legal counsel if you cannot afford one, one will be provided for you at no charge.
