Question:

What are my options in a forgery case?

I recently had dinner at a well know restaurant and the waitress altered the receipt to give herself a tip. I brought it to the managers attention and all he did was refund the amount of the tip, and state that he would bring this to his bosses attention. Do I file charges against the waitress/restaurant or do I wait on the restaurants solution?

  1. The action you describe is not forgery since she didn't sign your name.  Since you have recovered your money, you have been effectively taken out of the equation.  Let the restaurant handle it.

    You can't file against the restaurant because they didn't initiate the action and they provided you the refund.

    You could charge the waitress, but you would have to prove it and that may be difficult at this point.

    I doubt the police would really be interested since you already accepted your refund.


  2. you would have had more of a case to go on if you hadnt already taken a refund..if you already accepted what the manager offered its kinda a bit late to complain now, as far as theyre concerned they've dealt with the situation
