What are my rights are when buying a car from a dealership,i think the dealer is doing something illegal?

I initially started shopping for a car on May 15, 2008 now almost 2 months later still dont have a deal complete. I bought a 2008 altima coupe and had to return it because after signing the contract and driving away with the car they told me they could not finance the car. After returning the car i made a deal on a 350z signed a contact for that car. I got many letters and no back has appoved me for the car which is fine with me because now the car is making noises and i want to give it back! the dealership told me they are going to finance in house at the same terms now they are telling me my payment is $2.00 more that what i signed the contract for and that one bank finally decided to finance my loan, after they told me prior that they would not finance the loan. I believe the dealership tampered with my loan.

  1. If the dealer asks you to sign a new contract just say NO.  This may get you out of the deal, or this may put you back on the original contract that the dealer will hold in house.  If you do not sign a new contract and the dealer takes the car back they will charge you for every mile you have put on the car....we charge 29 cents a mile...if you have put 2500 miles on the car you would owe them $725.  Just be ready for whatever way this goes.  People think they can take a car back to a dealer and walk away without owing money and that is not the case.

If they finally got some one to approve you go sign the contract and bless the F&I Manager that got it bought, it sounds like you beacon score qualified you for a or else the trade they took you out of was so upside down that a floating drydock couldn't get it raised. Right now 2 bucks is a miracle of modern finance. Be grategul.

  3. No sounds like you have really marginal credit. I can almost guarantee you that the way the contract is worded, you are obliged to take the car and make the payments. How you couldn't qualify for an Altima but get a Z car tells me you are paying WAY too much for the Z, but I think it's too late for you now. Sorry. Read your contract. Maybe there's a way around it, but I doubt it.

  4. I have no legal basis for this, but I would say you have the right to return the car to the dealer because you do not agree to the terms of financing through them. When you took the car, part of the deal was to be financed through _______ bank. Now that ________ bank will not finance you, the terms have changed and you should not have to accept them.

    What would you say if they approve you from bank X, and then next thing you know you are now financed through bank Y? The deal is now different and not what you agreed to.

    Again, I have no legal reference, but this is the point I would argue if you do not wish to keep the car.
