What are my rights? as a father

my ex girl friend and i have broken up, but before we did, she told everyone is was pregnant, i found out after we broke up and now she will not tell me if she is or not, or though she has said that if she is, her new boy friend is putting his name on the birth certificate, to make it so i have no rights to see the child, i must as the father be able to do something, if passable i'd like custard.

  1. LOL sorry, but did you say you want custard?  What does pudding have to do with your baby?  =)

    All joking aside, I'll assume you meant custody.  And no, the judge will not give you custody based on the fact that you live in a better area.  Unless you can prove in court that the mother is extremely unfit, you will not have primary custody.  Your best bet is to save your battle for something more realistic, such as joint custody.  This can only be done after you get a paternity test to prove that you are the biological father.  If the mother will not voluntarily submit to one, go to court and get a court - ordered test.  You can proceed to fight for joint custody from there.

    Before you get all worked up, though, you need to find out if your ex is indeed pregnant.  The best thing you can do for your potential future child is to remain amicable with your ex.  Call her and ask to have a calm, civil conversation with her.  Then ask her if the rumors are true, and tell her that you would like to help her support the baby.  Good luck.

In wisconsin if your un married you cannot put a mans name on the birth cert unless you get paternity testing or the man signs a noterized paper stating he is the father. As for you finding out if the baby is yours or not I would consider talking to a lawyer. Most of them will give you a free consoultation.

  3. custard?  You mean custody.   You have have to go to court and get a court ordered DNA test.  If you are the father, you then have to fight for custody in court as well.  Unless she is unfit and unless you can provide for a baby, the courts usually give the mother custody.  You will however have rights for visitation.

  4. You are going to have to wait until the child is born and then go to a judge to get an order for a paternity test. If you truely feel that this is your baby then seek some legal advice on what you can do.

  7. hmmm seems to me as though you need to make her listen to your point of view and work out if u are the father datewise, then if u are make her understand you want to be a part of it and not cast aside as every child has a right toa father..... i didnt and for that reason i kinda resent my mam....just dont want her to be resented if she does that to you

  8. You have the same rights that she does.  

    Get a DNA test done when the baby is born.  IF she doesn't agree to it, get a court order.  She can put whoever she wants on that certificate, its up to you to get it changed by the court and you have that right.  You will be obligated to pay child support for the child if the child lives with her, but you can fight that also and get either visitation or fight for custody  if you feel you are more stable .  

    Talk to a lawyer before the baby is born so you can have your game plan set up.

  11. I know it sounds a bit scary but the legal route is just about the only one available if she wont compromise with you! You will have to get a DNA test done so you can have parental responsibility, thus making things easier to get access once the child is born (if the child is yours). You won't get custody unless you can prove she is a negligent mother.  However, if the child is yours you could try for joint custody or at the very least get a visiting order so you can see your child.  First you need to get a DNA test done, so nothing can be done before it is born but you should speak to an organisation like the citizens advice bureau which is free (if you dont have that in your country you will find something similar).  You cant change the name on a birth certificate once it is down though so you will need to act fast if she is pregnant!  Find out what your rights are!  You will have to give child maintenance to the mother (a percentage of your wages probably) if the child is yours.

I would tell her, that you want to be a part of your child's life.  If she gives you problems about it, talk to a lawyer...you can go and get a free consultation almost anywhere.  And she should be aware that her "new" boyfriend cannot sign a birth certificate if he knows the child isn't his.  They would be signing a legal document, illegally.
