What are my rights to collect child support from parents?

does anyone know if i have raised my nephew for a year which was by my choice to give him a better home. but his parents took him from me. i am fighting everyday to get him back. but i have paid all his expenses,school stuff,and i have him on my health insurance until novemeber. do i have the right to sue them for child support and to pay for the insurance im paying on now. our drop date isnt until november. its not about the money as much as making them pay for not taking care of him now that they took him away. but i am fighting legally to get him home where he belongs.

  1. on the surface it would seem you may have a case, but be advised, it is the courts that will/do determine where the boy should live, not you. we don't know the why/how reasons for this situation, but that's also for the court to decide.


  2. You always have a right to sue - the question is whether or not you'll prevail.  Take it to small claims court - you can get up to $5000 back (but they may still never pay you).

    The bottom line is you're angry that your sister/brother are deadbeats and unfit parents.  But it's still their child.  You did a good thing for the time that you could.  You might sill put some money aside for a college education - when the time comes.  Aside from that - there's nothing else you can do, but be supportive.
