Can someone please tell me rights when I am underage and at a party where alcohol is present. If a cop randomly comes up to me and says "blow on this" (a breathalizer) do I have the right to refuse? I want to know so that incase a situation occurs where cops bust a party that I am at I want to know how to handle myself and not get an MIP and please don't state the obvious "JUST DON'T DRINK" thanks

  1. just being at the party with alcohol makes you guilty of PIP.

If you are at a party where there is alcohol,  LEAVE or prepare for some time in juvy.

  2. They can charge you with a misdomeaner--underage drinking.  If you refuse the breathalizer, they will still charge you.  The fines are really high and it will go on your record.

There are a lot of posts on her from guys busted for underage drinking.  You get arrested, go to the police station, and get a court date.  It's not worth it. You won't have any problems if you aren't drinking at the party, the host and any adults over 21 will.

If the cops show up, find the nearest exit or window.  Don't hide, they'll always find you.  Any one there may also narc you out.

  3. Most states don't give you the right to refuse.  I lie...I live in Nevada...if you refuse a breathalyzer, they automatically take you to jail for DUI, etc.  The only right you really have is to SHUT UP.  Don't admit anything, don't offere any information, otherwise your screwed.  You really shouldn't be at a party if your a minor where alcohol is served.  It is just stupid, I know, I've been there.  But if you haven't been drinking, why not provide a breath sample?
