This is an offence to hate scheduled caste/tribe people by insulting orally, writing, by actions etc. If the insulted person complaints against the insulting person, the victim (complaint) is deemed to be right. The liability falls on the other person to prove that he had no intention to insult him/her.

The general category (by caste) person has no right to make such complaint. This law is made in phylosophy of thoughts of Mahatma Gandhiji. It is called that in many cases, for harassing some persons this law is many times misused. Like this Dowry Act is many times misused, and many female or her family complainant have misused IPC section 498-A regarding harassment by in-laws or husband etc.
