it is paired with something else but i dont have that phone anymore so if it works for my sync how do i unpair it and pair it with my phone??

I'm pretty sure you don't have to un-pair your bluetooth headset. Just follow the same pairing steps you did to pair it with your first phone and it should work with your new phone.
