my partner wants to adopt my 3 year old as we are having are first baby together and he wants them to have the same surname but we do not live together can he still adopt

  1. This is really not a good reason to adopt at all.  Adoption means that he will be the parent.  He will be responsible for child support whether or not the two of you stay together.  Your 3 year old will have inheritance rights whether or not you two stay together.  

    Also, what about your child's father?  

    Your child is 3 and already has a name.  That name is part of who your child is.  Is it so important that everyone have the same last name that it's worth your child giving up part of his/her identity?  

    If it comes down to that and the name really is a big issue, opting for a legal name change will take care of it.

    Just some things to consider.


  2. I don't know the adoption laws in the UK (sorry) BUT adoption is not just about having the same last name.  It is about raising and loving a child. How can he raise your 3 year old if they aren't living in the same house? Does he really want to parent your child or does he just want everyone to have the same name because he thinks that would be easier? If it's the latter, that's not a good reason to adopt.

  3. You would need to ask the child's father to sign over his parental rights

    Any family solicitor would offer you an initial consultation, usually for free.  This would be far better than asking random people on Y!A?
