  1. if you cant spell the crime they really throw the book at you

    (burglary)

depends on the degree 1st, 2nd, 3rd.  all are felonies but carry different sentences

  2. California does not have "sentencing guidelines" such are used in federal court.  Whether a prison sentence is imposed, or probation is granted, or the case is reduced to a misdemeanor (which is possible in some cases), is all pretty much within the discretion of the judge, and is going to be based upon many factors including the circumstances of the offense and the background of the offender.  What sentence might be applied in any particular case is impossible to say.

BTW, there is no "third degree burglary" in California.

  3. Depends on what kind of burglary you're talking about.  First degree burglary (which is usually when someone breaks into a home), is usually prison, because you would not be eligible for Probation unless there were unusual circumstances in your favor.  If it's first degree burg and there's a person inside the house when you break in, that's an added enhancement and you're toast.  First degree burg also counts as a "strike" under the 3 strikes law.  If it's 2nd degree burg, which is usually charged in shoplifting cases (where they can prove you intended to steal, for example you had no money in your wallet), you are usually put on Probation.  Lots of factors though for both, so you would need to be more specific.
