What are the chances of getting a US tourist VISA when your brother has TNT over 5 years ago?

Some friends and I want to go to the U.S. for a vacation but one of them has a brother that went to the U.S. and has overstayed until now. What are her chances in getting a visa (even a single-entry one)? She's married and has a child who are living in the Philippines. And she has a business as well. Even with these factors, what are her chances?

Also, will the U.S. embassy know about her brother and make the connection and automatically decline the visa application?

And how much does it cost to apply for a visa anyway? Thanks

  1. the fee for the visa is of 100$ non refundable

    the likelihood of your friend receiving a visa is very slim to none ,

    i realize by no fault of hers, her brother did overstay in the US , it makes her also a candidate to more than likely overstay as well , her brother already illegally in the US will seems more than suspicious on the documents required for the visa requested;

    and it probably be denied.

So many questions!  chances are that your friend will not be granted a visa if she has a close relative who has already set up house illegally in the US.  The Embassy will know, especially as she will need to tell them on her visa application (of course, she can lie, and just perpetuate her family's shoddy behavior, but that will certainly seal her fate and she will be much less likely to ever get a visa).

    The (non-refundable) visa application fee is US$100.00.

I think your friend has a big chance of going to the us,in the ds156 form they dont ask you about your immediate family so they dont have any way to track the relative unless you indicate the overstay person as the person you will be staying with in the us.The consul will focus more on your ties,I think thats the part that you should be worried about.
