tom sees a psp with a price tag of $50. it is the last one left. however at the register he is told he cant buy it because it is a typo, the actual price is $150 ( or a vandal had switched the tag).

can tom insist that they sell him the psp and wat torts are involved?

  1. No, he cannot insist that they sell it to him.  A store is not responsible for typographic errors in prices or advertisements.  There is no tort involved, because Tom has suffered no injury.


  2. This in not a tort, it is a contract issue.  Did the store make you an offer by putting a $50 price tag on it?  You accepted by presenting your self to buy it.  The authority on this is split.  You could sue in small claims court, and ask for it.  Or the damages to make you whole.  They might just make you a deal.
