  4. First, check to see if anyone is injured.

    Second, get everyone to a safe place.

    Third, echange contact and insurance information.

    Fourth, if there is more than a couple hundred dollars in damage, call law enforcement to get a traffic accident report.

    Fifth, report to your insurance company.

  5. 1. Stop exactly where the cars collided, DO NOT MOVE the cars.

    2. Get out of the car, motion for the other driver to do so as well, if (s)he is able.

    3. DO NOT ADMIT FAULT. Do not say 'sorry,' or 'I should have looked,' etc.. Say NOTHING to admit fault, even if it was clearly your fault.

    4. If the other driver is able to exit the car, ask if (s)he is injured. Ask if any passengers are injured.

    5. CALL THE POLICE. Explain the situation, your location, and say if anyone is injured. Do not admit fault to the police officer, either.

    6. While waiting for the police, exchange insurance information with the other driver.

    7. Once the police arrive, (s)he will look at the cars involved. You will both need to give your report of exactly what happened, one at a time, as well as show your driver's license, vehicle registration, and insurance information, provided an ambulance has not been called. Again, do not admit fault. This is for the police officer to decide.

    8. The officer will write an official accident report and give you and the other driver a copy.

    9. The police will call a towing company if necessary, and give you a ride if necessary.

    10. Provided your car doesn't need towing, the police officer will dismiss you and the other driver, and you are free to drive home.

    11. Once you get home, call your insurance company IMMEDIATELY. You will need to explain what happened, and give all the information you gave the police, including the other driver's insurance information, so they can contact that company.

    12. Call the other driver's insurance company. Again, do the same thing as you did with your own insurance agent.

    13. Be expecting numerous calls throughout the next few days, asking for more information about yourself, your insurance, the other driver, his/her insurance, etc.. Be prepared to give a statement about the accident to both insurance companies. This statement will be recorded and used in determining whose company is to pay for damage. The agent who records your statement will legally be required to tell you when you will record, and what questions they want answered. If necessary, go get the official accident report from the officer to read to the agent.
