  3. I think it would be that they don't get the funding they need to provide services.

    Even so, the IDEA law that mandates how schools are to do special ed for children states that schools can NOT refuse services becuase they do not have the funds.

    I dont' understand this, but it is true.

    Another thing is, that according to this law the special ed child is to be in the regular classroom with reg ed kids UNLESS  the child can not succeed in this classroom.

    This means that a special ed teacher is SUPPOSE to be in this class to help teh child and the regular teacher is there for the reg ed class.

    But, I have NEVER heard of this happening. SO many reg ed teachers say THEY have to handle all the kids themselves and they don't have enough time to do it all.

    This is ILLEGAL on the schools part. The reg ed teacher is NOT suppose to handle and teach the sped child in that class because they are not formally trained and qualified to help the sped child. This training and qualification is REQUIRED by the IDEA law that mandates special education.

    The reason this is happening is because the SCHOOL is trying to save money by having all the kids in the same class (some are NOT suppose to be there, some are SUPPOSE to be in the sped class)

    AND they are saving money by not hiring sped teachers.

    ALL of this is ILLEGAL and this 'challenge' is the  schools own fault, they bring the trouble on themselves by doing these things that are ILLEGAL.

    It is not the teachers who are doing these things, they are only doing what they are told to do by the administrators. And the administrators  are cheating the children out of their education.

    And WE as TAXPAYERS are paying these peoples paychecks to violate FEDERAL laws and cheat OUR childrens education.

I would say getting the kids qualified for services in the first place.  Each state has their own rules about just who qualifies and how they qualify.  However, these qualification requirements can leave lots of kids just on the other side of getting help.  Then they have to help the parents understand just why one child qualifies and another does not.

    The entire process is just one obstacle course after another  before education or class assignment can being.

    In providing services, the best quality of care can usually (not always...if a teacher is an idiot) come with the number of teachers available to help and to provide various levels of support.

There's usually a shortage of teachers that are certified in ESE, so some schools put too many special needs students in a class, which makes it really difficult for class management.  Also, there's so much paperwork for ESE students that takes up so much time.  Another problem is when you have emotionally disturbed kids that can get agressive and hurt themselves or other kids, and you know they can be hard to control at times, things can go wrong, then there are lawsuits.

    You have to get parents' permission to restrain them, and some parents are less than cooperative.
