What are the laws of marrying a non US citizen

My fiance currently lives in Jamaica and we want to get married early next year; however we do not know the laws of him becoming a citizen; or if he would be able to live here with me?

  1. You should file a petition to get him a fiance visa.

    Assuming you are a US Citizen (non citizens are not eligible) you will file forms....

    It will take about a year for the visa to be issued.  After the visa is issued your fiance will have 6 months to come to the United States.  Once he's here he'll have 90 days during which to get married to you.

    After the marriage he'll file....

    I-765

    with the USCIS.


  2.     If he has a valid Jamaican passport and visa, he can travel to you (this way you have the option of the wedding taking place any where in the world you want), the longest he can stay in the US is usually 6 months. If he doesn't have these documents, he NEEDS to get his passport. You'll have to get married in Jamaica. After you get married to him, you petition/"file" for him to be a "legal resident", or a "green card holder".

        If homeland security approves his paperwork,he will need to have medical done (they send you to their doctors) where they do the tuberculosis test, and draw blood for HIV, and Syphilis test. They'll send him to a place to get his finger prints done, then they'll use his finger print to run a background check on you.

        After that you guys will wait to see if everything is ok, you know, to make sure he's not a serial killer or something. If you are petitioning for him and he has underage children, it is crucial to state this when doing the paperwork. When everything is ok, and he has any children he has to take a DNA test to prove that he is the father, Maury moment huh? When everything is proven to be up to U.S.'s  par, they will send you in for an interview with an immigration officer, if he has a visa and he is coming and going, the interview will take place in America, but if he only has his passport, the interview will take place in Jamaica. When you go in for this interview, you need to have proof of the wedding i.e. pictures, wedding certificate; if any of you have been married and divorce, you will need the divorce certificate. If you are a citizen, he will be a legal permanent resident in as little as 6 months, the wait can be longer, that is how long it usually takes. If you are not a citizen, and you are a legal permanent resident, the process will be longer.

        You guys will have to stay married for at least two years, so that US immigration will know that the marriage was a real one and not a business marriage, which is you marry him just so that he can get his papers.

        Now, he does not automatically become a citizen because he is married to a citizen. I think he can complete paper work to be a US citizen after within 3 years. They should give him the questions they will ask him, along with the answers. There are 100 questions that he will receive. Even though they may ask him only 5 questions, he should know the answers to all of them. They will schedule a day for him to come in to take the test.

    The questions are quite simple, such as

    When is America's independence?

    What is the fourth of July?

    What are the original 13 colonies?

    Who is the current President?

    What is the color of of the American flag

    and 95 more that I cannot remember.

And he HAS to be a legal permanent resident BEFORE he can become a citizen. It can be an expensive process.
