What are the north carolina vehicle reposession laws ? What are my rights ?

I had worked out an agreement on the past due amount, and all of a sudden yesterday the repo man calls me asking for the vehicle. He was mean when I tried to explain to him the situation. I need North Carolina laws, not federal. He is looking for the vehicle as I write this however, I haven't taken any calls from him since yesterday and he keeps leaving me nasty messages. Do I have any rights at all ?

  1. You can try to work it out with the lender but if the delinquency has gone so far as to have the account go to collection and the repossession company has been engaged, odds are that they will take the vehicle. They don't get paid unless they are successful in picking up the car.

    It's futile to try to work it out with the repo man. He's just doing what he's told to do.


  2. If your not making payments, they have the right to repo the vehicle. I did notice, however, the on the page I linked you to it says the repo must be peaceful. You might want to save those nasty messages from the repo guy...he might be violating the law, similar to how some debt collectors can get.

    Did you get that agreement, with your lender, in writing???
