  1. None.  Not unless they can prove intent.(if we are talking bottles, did you have the bottle opener in the other hand?)

         I know we are not talking a single here, you are holding 3 24packs or so stashed in the backseat of the car and in the trunk.

      Was the beer nuts and chips already opened?  How about the pizza-was it already cold and unappetizing?   Were you sitting around with your buddies watching sports in your underwear?  And were the women that hung around you generally known to be popular with everybody (and not because of their intellect)?  And most probable you have driven somewhere and driving is the only way you plan to get home.

      Then the question would be."Whats taking you so long to open the darn thing...do you have to read the instructions?"

    Penalties?  After the second,I mean forth,I mean 8th,I mean...  beer; you will forget about that.

  3. That would fall under the law for underage consumption.

    "To consume or POSSESS alcohol."

    If it were opened in the car and the person was under age they would get two charges, the second for open container.
