Is the situation more like "liar until proven honest" for the victim?

I am not saying -ANYWHERE - that it is a female's word agst a males' word. That is a FALSE ASSUMPTION. In many cases, there is evidence. Read the article I posted for the other question. Despite evidence, rapists are let go....

And, yes, this is a big problem with ramifications in public health and human rights. For those who choose to ignore it, so be it. I do not. I am an advocate.

  1. You know what, rape is rape, its been happening since Biblical times, if a man gets off, oh well, I don't think posting on the internet how many people get off is such a wise idea, it may give sickos ideas!!!  Rape happens, you can either get on with your life, or dwell on it for eternity and allow your attacker to make your life misserable indefinately, it is a choice, I assure you, that those who did not get prosecuted are not misserable, and yes, sometimes women DO LYE about being raped, believe it or not!!!

Court proceedings are an adverserial matter.  In rape cases, the defendant (rapist side) needs to prove that the rapist believed that the s*x was unwanted, and that the woman communicated this clearly.  Thus what happens is the defense attorney starts to attack the victim's credibility, to give the jury a tainted picture of the woman.  Then they use this to show how the woman's actions and previous behaviors, in all the other areas of her life, could make her look like a "vindictive liar" or as someone who is a big tease, or whatever.  They'll call up a woman's past sexual history to make her look like someone who gets involved in sexual relationships a lot.

    Of course, this is all a load of BS, because none of it has anything to do with what actually happened.  But the jury often makes decisions based on a woman's credibility and character, and not on the facts.  As a whole, our society contains a lot of people who have very traditional views of what a woman's role is, and what acceptable conduct for a woman is.  Its called the sexual double standard: Men with a lot of sexual partners are seen positively, whereas women with the same are seen negatively.

    I don't think the issue has anything to do with women being seen as being vengeful or liars.  I think it has more to do with a more general stereotypical view of women.  Society allows the stereotype because it believes it.  And we're all guilty of this, to some extent - not with regards to women, but with regards to holding stereotypes about certain groups of people.

    As for what can be done, well, the most sure-fire way is to stop seeing "people" and to start looking at individuals.

  3. I think that the repercussions are how women are seen under the eyes of the law. I don't think that all judges are going to look at a woman who is saying that she got raped and just immediately assume that she is crying wolf. I don't think that women lying about rape is a huge occurance and I don't think that that is the biggest stereotype that is tagged to women, but I do think it's out there.

You really want a system where anyone can put anyone in jail, just based upon their word?  What kind of stupid fascist idea is that?  It's not about someones word, it should be about the facts of the case.  And the court should be skeptical of any claim, not just assume that because a person is male or female that they can't or won't lie.  If the number of innocent people in prison is low, then the system is doing fine and should continue as is.

It's convenient for men in power (and sometimes otherwise) to believe that women are liars.  If they didn't they would have to admit that women were human and treat them accordingly.  This might infringe on their male privileges, which DO exist, regardless of what antifeminists might tell you.

  7. You're completely missing the point.

    Innocent until proven guilty. The burden of proof rests on the prosecution. No one can be found guilty unless proven to be guilty beyond all reasonable doubt. This applies not only to rape, but to all crimes.

    You say the number of innocent people in prison is low? I say it's because of the things mentioned above. You can NOT convict someone on someone else's word alone.

    Note that a failure to convict does NOT mean that the woman is automatically lying, it just means that there was not enough physical evidence to actually justify a guilty verdict.

Liars are not trusted. and are untrustworthy.  They lack respect, validity, and considered weak.  Lying is a display of insecurity, self delusion, and a weak ego.  Women are certainly less vengeful than males.  Males kill their estranged spouses, their children, and are very vindictive.  Rejection to a male creates a very serious wound to their ego, and they want revenge.  The law now reqires that a girl who is raped, seek attention in an ER, where the results of the forceful sexual attact results in tears in the vaginal walls, and swabs are taken of the secreations in the v****a.  These swabs are then preserved, and tested for s***n.  The DNA in the s***n is irrivocable proof that can only be provided by one male.  As well, rape is usually accompanied with a beating.  

    and the woman has blunt trauma bruises; if shes lucky enough to live.  My mother used to believe that if the women who claim rape wouldn't have put herself in a compromising position, then the act would'nt have happened.  But most rapes are done in conjunction with home invasion,  jogging, and forceable kidnapping.  Guys still retain the belief that women really do want to be raped.  It's every womans fantasy.  Well not mine.  If I were raped I would fix the physical  characteristice of the banana slug in my mind, and knowing I would eventually find him, shoot him in his genitals., and just leave.  Not kill him, but ruin his equipment.  That is how I would handle it.

  9. I do believe that when it is proven beyond a shadow of a doubt that a woman was lying about being raped to be malicious, then she should get the full sentence that was going to be placed on the man if he would have been found guilty.
