What are the responsiblities of a bankruptcy attorney?

Specifically in reference to a Ch. 13..but all responsiblities are welcome..this is responsibilities to the consumer. I want to make sure I find a good lawyer. Thanks!

  1. obtain a credit report

    Inquire about any additional debts privately you owe

    ask about you r income

    prepare the papers

    file papers in federal court

    attend meeting of creditors with you

    consult with you during all proceedings

    File any additional items as needed

    mail you a copy of your discharge papers once you have attended the mandatory exit classes


  2. The other answers are great....basically the attorney is making sure your interest is protected, your paperwork is filled out correctly and filed on time, and to represent you in court.  

    But from my observations, their main concern is to make sure they get paid.  I've seen a lot of bankruptcies get messed up by poorly trained lawyers.

    To find a good one, check with the local bar.....but also try asking the local BK trustees.  They work closely with these attorneys and know who the slackers are.

In a chapter 13, the attorney should gather all your income, credit report, attend court dates with you...file any documentation, modifications, dismissals, etc, needed per the courts, and will be your attorney throughout the process of your bankruptcy. How to find a good attorney?? When you find one and need to know some history, you can look up the bar association and see how long they have been active, if any complaints are filed against them....when you go see an attorney, ask them how long they have been in practice, what types of cases the handle.......this will help give you a good idea if they are good.  Ask friends if they know someone they can refer you to.......Good Luck!
