  1. In the UK there are sentencing guidelines for magistrates and judges, as well as guidance of case law.


  2. Law enforcement does not sentence anyone. They investigate crimes.

  3. Law Enforcement does not sentence people, judges do.

    Each state has set standards on sentences developed by, penal code, court rulings, and defendants priors. These books are usually on the bench or in his/her chambers.

    Here is the Federal sentencing guide, but its close to most states and will give you some idea.

    Note it sets a number for each criminal activity, then adds "adjustments" like hate crime, age of victim, monetary gain etc... Then it comes to a numerical "Offense level." The judge will refer to the following table (it's in months BTW) for sentence :

    The last part the judge factors in is the sentencing hearing. This is where both the defendant and the victim (or vics family) give statements regarding the sentence. As you can see the judge had some leeway in what s/he gives, but not much.
