What are the statutes of limitation on a speeding ticket in NJ?

I got a speeding ticket in sept. 07. My orginal court date was set for Dec. 07. I had to reschedule and went through the process of excusing myself from the original date. Paterson never sent me a notice of rescheduling until the other day. It is scheduled for the same day I got the ticket in sept. 07. I was just curious if there is any way I can get out of the points. I don't want my insurance to go up.

  1. Speak to the prosecutor about downgrading to a non-point violation, though don't be surprised if they interpret the postponements as an calculated move to carry the trial beyond the officer's reasonable memory.    Many people do exactly that.  

    The statute of limitations deals primarily with the time, after the offense, in which a charge must be filed.  Once it is filed, it's a totally different ballgame.


  2. The statute of limitations is the time from the offense, until you are charged. Because you were already charged, it does not apply.

    Your best bet is to attempt to get some type of diversionary program, such as traffic school, or an amendment to a violation that does not appear on your record.

    Challenging the radar, hoping the officer does not show, and other methods may work, but the odds are slim. Also, once you get to that point, it is too late for a plea bargain.
