what is the process that i and my husband have to take to make him a citizen.

he is an illegal alien....

do we need a lawyer for this process?

  1. Your husband must live in the USA for at least 5 years before applying for the Alien Card. Once he's a legal alien, he can apply to be a citizen.  


  2. If he entered the USA more than once illegally, he has to leave the USA and apply from his home country. The catch is, that he will not be re-admitted to the USA for 10 years as his punishment for having entered the USA illegally more than the one time.

    So in your case, if he only entered the USA once illegally, I really do suggest you get some advice from an immigration attorney.

    If your husband entered the USA more than once illegally, consider moving to his country as he is going to be away for ten years.


  3. Tell him to go back to his country and apply legally. We have enough illegal aliens here already.

    If it is determined that you married him just to allow him to become a citizen you are liable to be prosecuted for violating immigration statutes.

  5. He is miles away from being a U.S. citizen. First, he would have to be a legal permanent resident. If he was a permanent resident for a certain period of time, he could apply for citizenship. He's years away from that day.

    If he entered the U.S. without an inspection, he's years away from becoming a lawful permanent resident.

    You need to submit form I-130, the fee, and the supporting documents to CIS to get things started. If you can afford a lawyer, hire one.
