I'm an asian and my husband is an american and we married last year at the third country. We have a 2 years old baby who hold american passport. How do I get the US visa in fast way? What are the steps to do after we are married to apply for US green card? He said it'll take too long if he files from US and he thinks that it'd better to file it from asia. Is it true?

  1. The only way he can file from a US embassy is if he lives, permanently, in that country.  If he resides in the United States he must file in the United States using the CIS Service Center that has responsibility for his state.

  2. true

  3. If all the paper work is in order it should take 6+ months for your visa. Here are the steps

He will need the following forms:

    -I-130

-G-325a one for each of you

-Passport pictures two of each of you

-Copy of Certified copy of Marriage certificate NSO

    -Proof of his US Citizenship

    -filling fee

After completing the above he will send your package to the USCIS Office that is listed for your state.

OK, After he has filed the above form and have received notice that it has been received then he will need the following forms:

  4. if you husband is in the US? he may file for you and the child to come to the US ,

there no fast way to get a visa, it takes a while to obtain one

since your child is already an US citizen, i imagine you had your marriage transcribed at an US consulate?

in which country did you get married? i ask this because you stated # What are the steps to do after we are married to apply for US green card# are you married or not ? i am not sure of what your are saying ?

a green card will be given to you after you are in the US

if you are NOT married? your future husband may file a petition as a fiance visa

How Do I Bring My Fiancé(e) to the United States?

    Background

If your fiancé(e) is not a citizen of the United States and you plan to get married in the United States, then you must file a petition with USCIS on behalf of your fiancé(e). After the petition is approved, your fiancé(e) must obtain a visa issued at a U.S. Embassy or consulate abroad. The marriage must take place within 90 days of your fiancé(e) entering the United States. If the marriage does not take place within 90 days or your fiancé(e) marries someone other than you (the U.S. citizen filing USCIS Form I-129F - Petition for Alien Fiancé), your fiancé(e) will be required to leave the United States. Until the marriage takes place, your fiancé(e) is considered a nonimmigrant. A nonimmigrant is a foreign national seeking to temporarily enter the United States for a specific purpose. A fiancé(e) may not obtain an extension of the 90-day original nonimmigrant admission.

    now if you are married?

How Do I Bring My Spouse to Live in the United States?

    Child

Petitioning Procedures: Bringing a Child, Son or Daughter to Live in the United States

if your husband is in the US , he must petition for you and the child to come to the US .

  5. he either files the petition for you from the States (takes about one year) or he has to go to the embassy in your country - don't know how long it takes but you have to have Dr. check up and fill up papers, pay fees

you can apply for green card after you have some status when you are in States

    good luck
