  1. Some jurisdictions restrict an injured Worker to the Workers Compensation system and have abolished common law remedies.

    When there used to be common law rights here in South Australia the two torts that were most often pleaded were "Negligence" and "Breach of Statutory Duty"

    The latter is a tort, even though it has 'Statutory' in its name.


  2. A worker injured on the job (during the course and scope of employment) is limited to the workers compensation system and cannot file under general negligence causes of action.
