What can I do about a terrible car crash?

Well, I've had my drivers license for a little over 2 months now, I'm extremely cautious. But 2 days ago, I was driving on a public road, and theres a four way stop sign, I stop then begin to pull out in my 92 Volvo 240, and i see a blazer flying towards me, I couldn't do anything, but i smashed the gas and threw it into second to let it hit the trunk instead of the cabin of the car. I got out to see 2 girls from my school, the one got her license the day before. She didn't see the stop sign because they were taking pictures of themselves. She didn't even look up until she was threw the stop sign. But her dad works for the police station, and didn't even get a citation, fine or anything. When I had to go to the hospital for a broken jaw and dislocated shoulder. And since her daddy got her off scott free, I have to pay my own hospital bills. $4000. How can I get help?! Her daddy said it was both of our faults, so am I not supposed to stop at stop at stop signs?

You do not need an attorney just yet.  Call her insurance company and report the claim.  She should have done this already.  The adjuster will complete a full liability investigation.  It will be the adjuster who assesses liability, not her father or any other police officer.  If this was a four-way stop, then it does sound as if she is at fault for the accident since she failed to stop at all.  

    Depending on where you live, and your state's comparative negligence laws, you should be able to get reimbursed for your medicals less your percentage of negligence, if any.   They should also pay for the damage to your vehicle, and offer a rental.  

    If you live in a No-Fault state, you may have PIP coverage.  This will cover your medical expenses as well.   Your insurance company will pay and subrogate.

    If you are under 18 years old, have your parents report this loss.


  2. Hopefully you have auto insurance, if so, you should have medical insurance on your auto insurance policy to cover your hospital bill no matter who's at fault.

    Most importantly call your insurance agent and file a claim, "be honest" and tell them exactly what happened.

    File an accident report with the state, it's required in most states and again "be honest" and tell them exactly what happened.

    It doesn't matter what the girl's daddy said or did for her....you tell the truth as you did in this post and let your insurance company fight for you, that's their job.

  3. I hope you have a good insurance company.

    See, your insurance company doesn't want to pay! They want the other insurance company to pay. Tell them what happened. They will investigate the story. They should be able to reconstruct everything and they will be able to determine if some kind of cover up took place. Good luck!

  4. You have to get a lawyer and file it with your insurance company. If her dad was the guy at the scene and investiged the crash, you could sue her and him. If you dont sue , your an idiot. SOrry but its the truth. You need to contact a lawyer, they would love to take this case. The best thing is, most lawyers dont charge you any money unless you win, and you can make the girl and dad pay for it.
