I am not illegal. All my paperwork is legit and submitted.

Now that's outta the way. I worked for this company two months ago and they still haven't given me a paycheck, they haven't even given me a date of when to expect it. Here I am two months later, asking about it and still no results, I am extremely frustrated so I ask, What legal action could I take to ensure that I get my money? I want to put pressure of them by maybe filing a wage complaint with the labor dept but is that the best way? Basically, what is the best way I can get my money with or without involving the appropriate authorities? As long as its not expensive like hiring an attorney I am going to try it.

  1. Send them a certified letter, return receipt requested.

Tell them this is demand of payment for the period of (Dates worked)

tell them you expect payment to be made no later than  (Date).  if check is not received you will have no choice but to take them to small claims court.

It depends on how large the company is but you may be able to look online and  get the big bosses names and phone numbers, if you can find those numbers then just start calling and bugging them everyday.  Good luck.

  2. tell your employer that you are very frustrated that they have not paid you and say listen, you need to pay me or im going to the authorities. 99.9% of the time they will pay you because they don't want to get sued.  if they still don't pay you, quit and get the police involved. you should also ask your coworkers and see if they are getting paid because if you're not getting paid, most likely they aren't either. if they aren't you should bring everyone that you can find who's not getting paid and confront your boss.

  3. Go to your local district attorney's office for advice. They will tell you who to contact.

  4. send them a letter stating everything, that way you are putting everything on record, let them respond & if they don't send them another letter this time send a recorded delivery & mention "request no.2 & recorded request no.1" after you are through stating facts in this letter in the last line mention very politely that pls answer my letters else i'd be forced to approach the law for an intervention, mostly this would do but if it doesn't send them yet another letter with cc marked to labor dept. & other concerned authorities & a copy marked to the local police office, this should be enough.
