Question:

What can I do to get my sons child support money?

I went to court June 19 to get some child support established for my 3 yr old son. His dead beat sperm donor hasn't done anything for him since before he turned a year old. He owes about 10,000 dollars plus in back support. The courts don't seem to be doing anything to enforce this. They even waited 3 weeks to send off the garnishment notice to his job! Now they tell me that they are giving the job 45-60 days to respond. And my questions is what can I do to go around the courts or push the court to enforce this so my baby can receive the much needed support he needs from this deadbeat?

We were never married.

  1. If he is working be happy. Neither of mine are I understand completely. I went to supportkids.com but I am not sure they are helping much either. If you have done all the legally options there is not much left to do but wait. The only other thing is bug him but that might not work out so well he might quit all together.


  2. Unfortunately, there's not much you can do if it's being garnished out of his check.

    Once you wait the 45-60 days it should be a normal payment once a month though.

  3. That might be a part of this. Get yourself a good lawyer.

Everything you mentioned is typical & normal.  Starting up the order is the longest part.  Getting the employer to start up everything takes a bit of paperwork & waiting as well.  Legally the employers have that long to get everything going & started, because they may have recieved the order just after a pay period ended or in the middle of one.  There isn't really anything you can do, a judge will tell you to sit back and wait for the legally allotted time to pass & if you still haven't recieved anything, then come back to court.  "Legally" they aren't doing anything shady, it's all normal.  Once everything is in place, you will start getting normally scheduled payments every couple of weeks.

Unfortunately, this is the direct result of having and keeping a kid out of wedlock (at least married people have a bit more protection).  Yes waiting 45-60 days to respond it typical - it all depends on the laws in your state, and you can't shorten garnishment times when they are found it statute.

    Good luck - and stay away from men until you are married.

  6. You have to wait his job legally has 30 days each month to send you $$$ and sometimes it takes 3-4 weeks to get it even though it comes out every two. This sucks so bad but its just the way it is.
