What can I do when the person who hit my car and 3 others has a limits issue for property damage?

Someone hit my parked car and then 3 other parked cars causing $25,000 worth of damage to all 4 cars. However, because he carries the legal minimum limit of $5,000 propety damage according to CA standards, we all had to share a percent of the $5,000 and now I am out $1300 for my deductible and rental car I had for a month while my car was being reparied. Do I have any recourse? This seems incomprehensible that you can get away with this?

  1. I'm  guessing this guys insurance made  you sign a release before they sent you the money. If that is the case, you have no legal recourse. The release you most likely signed stated that you are releasing that person and their carrier from any further claims.

    Otherwise, if you have collision coverage, or rental coverage on your own policy, i would suggest making the claim with your company. If not, appears you have done all you can do.

  2. You actually have the legal right to sue him. For the deductible that is, the rental is your own expense and if you had coverage for it then it would have had been taken care of. The only thing that should not have came out of your pocket would have been the deduct., your insurance company should have informed you that they will be trying to get your deduct. back for you. Meaning the company will fight for your deduct.

    Talk to your agent about this.

Once the guilty party insurance is exhausted there is no other recourse.  Do you actually think this guy has any money for you to recover.  You can file a claim under your uninsured or under insured motorist or file a property damage claim and pay your collision deductible.  Don't look for any money anytime soon because your deal with coverages of $5,000 limits

  4. Have you used YOUR insurance to pay for your damages?  In this case, you would pay your deductible, and your insurance will fix your car, then go after the other party for you.  If they collect, part ot all of your deductible will be returned to you.
