Question:

What can I expect if I divorce?

discovered my husband is having an affair. We've been married for more than 12 yrs and have 2 children. On his large savings acct, my name is not included. Do I still get part of that money? Do I leave or make him leave? What would the consequences be if I leave?

  1. It's pretty hard to prove in court that someone had an affair.    

    I suggest that you talk with a lawyer to find out what your options are and what the consequences for you are likely to be.

Well, first, you need to decide if the relationship is worth fixing.  Yeah, 12 years is a long time, but how long has the relationship had problems?  If only recently, then counseling might be in order.  If you do end up divorcing him, then you need to consider what legal action to take.  If the money in his saving account was money that you helped to accumulate, then you are absolutely entitled to some, and should definitely get an attorney.  If not, then it might seem "money grubbing" for you to pursue it.  Also, you need to consider your children.  If your husband has been a good father to the kids, despite what he's done to you, then you need to make sure he continues being a part of their lives.  Discuss support and such, through an attorney, with your husband, and reach an agreement that you can both be happy with.

    And if at all possible, you both need to try and be "calm" about it.  In other words, it won't help you, him, or the kids, if you or your husband decide that shouting, name calling, and down right trying to punish the other is OK.

    I'm divorced myself, and I can tell you that it definitely hurts.  You really want to spend time with your close family and friends, and do things with your children.  It helps make the process a little easier.
