What can I legally do? ?

I purchased a brand new house 3 months ago. I was not informed and I did not sign any disclosures about my house being under a plane and helicopter flight path. I have air traffic and engine noise 24 hrs a day. The problem is I dont have a lot of money for fancy lawyers. Any ideas?

  1. I have never heard of a disclosure for a plane/helicopter flight path.

    If you have air traffic and engine nose 24 hours a day -- did you not hear it when you first saw the house or did your final inspection before closing? I don't think a home inspection report has a blank for "air traffic"

    I don't think you have any recourse? If it's that bad, see if you can have the windows upgraded to reduce noise.  


  2. I don't know as we don't know where you live like in what jurisdiction. But if you closed on it without knowing all of the facts, its hard to back out.

    If you are under a contract you can try and back out with the seller. But pretty much once you take possession and title, you take it as is. Of course, if you live in Florida, however, there are ways to sue the seller for not disclosing something like that.

  5. Normal traffic is something that can be checked out by a potential buyer.  It is not "hidden" nor "unable to be discovered" by the buyer.  

    Think about it.  

    If a freeway was nearby you would expect traffic on that road.  If a train track were nearby you would expect trains.  If a school is nearby you should expect kids walking to it.  

    And if an airport is nearby you should expect air traffic.  Therefore the owner did not have to "disclose" it as it was not hidden and you were quite capable of figuring it out yourself.  

    I suggest you get some ear plugs and learn to live with it.  

    (And when you sell your house,  are YOU going to disclose it or do you think you will not say anything about it either?)
