  1. If the suit is tried and a judgement is rendered, the agency can see to it that the judgement is enforced. Ideally the methods used would generally be wage garnishment (depending on the state), and depending on other factors namely, whether or not that collection agency has the authority.


  2. They can file a judgement against you and have the debt repayment applied to you paycheck as a garnishment (most likely), or they can attach it to other assets, such as bank accounts, property, commissions, etc.

  3. Keep in mind Statute of Limitations is an affirmative defense; meaning you must raise it. They can still file & get judgment and even execute in the form of a garnishment, bank attachment etc.

    If they have judgment and it's legit try to negotiate a settlement.

  5. If the collection agency legaly purchased the debt from the original creditor they can file a civil suit providing the debt is not "time barred" which means it has passed your states statute of limitations on collection and the creditor has no legal rights to take civil action.

    If he debt is NOT time barred, then you had better work out some form of payment with them to prevent a court judgment and possible wage garnishment or bank seizure to satisfy the debt.
