What can i do about apartments management?

My apartment management are trying to fine me because i had too many people at the pool. (Four boys that are my nephews.) $100 but, only one got in the pool with me. the lease only says two per resident. The lady in the pool saw me with my nephews try to get in and told us we had to leave. Come on lady, it wasn't like there were four adults there. What should i do?

  1. Unless it says there will be a fine imposed anywhere in your lease or anywhere posted I would tell her to kiss you a s s! It might say two per resident but if there was no one else around then you werent inconveniencing anyone and unless your lease states if you get caught you get fined then you can tell her to stuff it. she cant start making fines up. I have never heard of such a ridiculous thing before. I would call the actual management company that owns the complex.  


  2. Do you have a friend at the complex? Have that person vouch for you, saying those other two boys were her guests.

  3. You had 4 at the pool, you broke the rules. They seem to strict too me, but it's in the lease and you agreed to it.

Tell them you discussed this with a lawyer who is a friend of yours (yeah its a white lie but it sounds alot better than "I don't want to pay this") and they said that since only one boy got in the pool, you could no be charged extra for this and that they can take you to small claims court if they don't like it.  

    If they keep on you and threaten to report this on your credit if you don't pay the $100 you can pay some of it (like $10) and then sue them in small claims court for the money.  

    Note, I'm not really sure if you have a case or not, so if this goes to small claims court you may well lose, but I'll bet they just punt the $100 rather than going to the trouble.  Even if it does go to small claims court, maybe you'd win - maybe not, but with only one boy getting in the pool I think you have a pretty god case - its not like they can charge you for just being there with 4 boys (but if they had their bathing suits on and were clearly about to go in the pool, maybe they can make a case that this was a violation).

  5. Would help to know what state you are in...

    In Ohio and Cali, that kind of fee wouldn't even be legal. Some states haven't ruled on it, and you could argue that the landlord is only entitled to actual damages when it comes to fees...

    Speak with legal aid or a local attorney to find out if this fee is even legal. If it isn't, you simply don't pay it...if they try to evict you, you will have an airtight defense against it.
