Question:

What can i do about this car accident?

Basically i was in the left turning lane, stopped ready to make a turn facing southbound. There was a car stopped in the opposite turning lane (heading northbound) I made the turn, seeing no one in the other lane. This other car (which i feel was speeding, but have no way of knowing how to prove that) was behind the guy in the opposite turning lane, went around him, and we collided... Any help with this guys? Very appreciated.

  1. You're screwed!    You pulled out in front of someone when you didn't have a clear view of oncoming traffic.

    Ways to deal with this in the future...

    1.  Let the opposing car turn first and take the chances

    2.  Ease out just a bit so you could see around the other turning car

    Never pull out if you can't see clearly!    Sorry about your accident.


  2. You could not see past the other stopped car. You chose to make a turn and there was another car coming. It is your fault.

    If you couldn't see you should not have made the turn,plane and simple.

    You may not like my answer, but I'm going to be honest with you. I was a cop for eight years, so I had to investigate accidents.

    If you were in a turning situation, and the vehicle you were in a collision with was proceeding straight, then you were at fault. The traffic laws in the vast majority of jurisdictions state that those turning must yield to those proceeding straight. It is the responsibility of the turning driver to ensure his way is clear and safe. [That is unless you had a left turn arrow]

    The only out you might have, as I see it, is if you are able to prove the other driver was driving in an unsafe manner - you stated you felt he was speeding. If the other driver was driving in a negligent or reckless manner he may share blame with you. But you would need witnesses or traffic cameras to back up your claim.

  6. Well it will be hard to do anything because it will be your fault for turn into oncoming traffic and not staying in control of your vehicle, sorry.
