What can you do if a credit card company takes you to court

capital one is taking me to court and now the cost is going to be at least $1000 more than the limit on the card. Do I have any defense to settle? I had just had a baby and lost my job...

  1. did you sign a mandatory arbitration waiver? Whatever, usually if a CC company has to take you to court, you will have to pay their legal costs. Try sending them whatever you can afford--at least you can show the judge your payment attempts and he/she may force the CC to work with you. Good luck.


  2. well before they take you to court, tell them of your situation, can you get unemployment checks, another job? Talk to a manager and say "hi, look I apologize for my debt and I intend on paying everything back but I can only send ___ this much per month. Can we work out a payment plan?"

    Chances are that they will work with you. If you can't send in a set amount then send in whatever you can. If you can only send $5 that week, send it in, next week send in $20, just send in whatever the heck you can afford to send in. Its better than 0 and they will know that you are serious about paying it off.

    Keep all your records for 7 years of the paid off debt.
