What charges does he face?

My boyfriend is 18 and got pulled over driving under the influence, he has no insurance on his car, a broken tail light, expiried tags and i know they impounded his car. This is his first DUI offence. Will he face any charges? What does he have to do to get his car back? Im really worried and just want to know all the details. Is there anything that can happen that i should be worried about? Does he have to go to court?

  1. the broken tail light is not a big deal, expired tags and no insurance can be a hefty fine.  you have to pay daily for the impound so the sooner you can get it out .. the better.  he can get his car back if a licensed driver goes to pick it up but in order to get it out of impound it has to have current registration and proof of insuance or alot of times the tow yard will not release it.  as far as the dui portion.. .yeah.. he needs an attorney.  he will also have a dmv hearing as well as going to any court trial or prelim. hearings.  be prepared to pay about $2500-$4000 when it is all said and done.  he will have to pay fines and also pay to go to classes regarding the dui.


  2. You don't say where this happened ... but if it's New York, OUCH!

    It could get pretty bad for him!  Revoked driving privileges until 21 for the DUI, Suspended license for the no insurance and no registration, the impound yard will charge towing and daily storage fees on the car.  With all the fines and other expenses your boyfriend would be looking at in NY, the final cost could easily go over five thousand dollars.  He needs a lawyer!

    To get the car out of impound generally he must be able to prove that the registration and insurance is current, or that he has surrendered the plates to the DMV (needs to tow the vehicle from the impound yard.) and pay all of the impound related charges, including the daily storage fees!

    He will have to go to court, he should have his lawyer at his side when he does.  He is in one tight spot, it will take a lot of hard work and time to get back to normal.

I know a lot of people who have gotten DUI's.  I am not promoting them by any means, I am just telling you the facts.  I agree with what the guy above said, except I don't think he will get a felony.  He will definitely have to go to court, but it's going to be okay.  He should get a lawyer and they might be able to reduce it to reckless driving.  The big thing here is that he had no insurance and was drunk.  The broken tailight is just a ticketed offense.  I know someone who hit a tree and a stop sign, was drunk, got a dui with property damage.  He waited 6 months before he could get his liscense back, which didn't seem long to me.  

    You just need to make sure he doesn't do this again.  The guy I know got 3, and for the second one he had to go to jail for a month.  For the third, a month as well.  If your boyfriend cleans up his act right now things can turn out okay for him.  No felony and that's good.  He probably won't get one because my buddy with 3 never got a felony.

    DUI's are really bad, but in all honesty A LOTof people do get them.  I am just telling you what will be going on.  He's going to lose his lisence for 6 months to a year, have to go to alcohol anonymous meetings, possibly take drug tests, and pay a bunch of money everytime he has to attend an alcohol class or meet with his probation officer.  He won't go to jail, it just costs a ton of money.  Good luck.  It will all be okay don't worry.

From experience, if he has a good, respected lawyer, then he should have the lesser charges dropped.  It helps if he is gainfully employed and or going to a college.  It also will help if his family is there and is well dressed to show support for him.  Be sure to have him dress well too, not necessarily a suit though.  Unless the judge is in an outrageously good mood, he will get hit with the DUI charge and will lose his license for 1 year.  However, he may qualify for a limited driving privilege which will allow him to only drive to and from work/school.

  5. DUI & underage drinking, Driving without insurance, Fix-it ticket for the tail light, and a ticket for expired tags could be the charges.

    Could add up to a felony, varying on how stuff is added and taken into consideration.

    He will have to go to the impound lot and pay a fee to get the car back. And yes he will have to go to court and could face a long probation or possible jail time.
