What comes in general maintenance of property?who is responsible for commen sewarge pipes damaged ?

I own a flat in a society in Pune. The commen sewerage pipe coming from Top floor to ground got chocke. My flat being on first floor was to affect.The bathroom water start to return back due to blocked.My family reported itto society members. They said as it your bathroom problem, you have to doit by yourrself. As I am staying away and din not want my family to suffer,I told them to get it done on our own.But I have told not pay monthly maintenance fees untill I come & resolve this with society. Now they are threatining of legal action.Please suguest.

If it is a common pipe of the building it is naturally the work of the Society, the society cannot back out of this problem, the best thing to do is to pay your maintainence and obtain a receipt from the society or best pay the maintenence by cheque, this way you will not default in paying timely maintainence to your society and your case will be strong if society takes legal action, it will show that even though you pay timely maintainence, society is cheating you by non performance, best to take photographs of the maintenence work if  you are doing it yourself
