Question:

What constitutes insurance fraud, my husband hit a rock with the lawnmower on accident and it ?

popped out and hit our neighbors (who we cant stand but thats another story) car. We told them and made a claim with our homeowners insurance (they are renters). So the neighbor told us she wasnt even going to worry about it cause it was a little dent. Well a week later we get a letter saying that they have mailed the neighbors a check for 746.00 for the estimate. My questions are:

Is there a time limit when they need to get it fixed

Can they just take the money and not worry about getting it fixed.

Should I tell the insurance company they havent even gotten it fixed, its been 3 weeks. I dont think they will get if fixed, they are scumbags and freeloaders. But is that insurance fraud? The got a brand new truck a few months ago because someone "hit them" I think it was intentional also, these people are shady

  1. I would just go to court and settle the matter and go on with your life and make sure you have a good lawyer.


  2. There is no requirement that they use the insurance money to fix their vehicle. Now, quit worrying about them and mind your own business.

  4. If they chose not to fix the damage and pocket the money. That is their choice. It is legal. It is not insurance fraud and it does not reduce your liability.

    You owe them for the damage you caused (and you stepped up and did the right thing). It is their choice to fix it or not.

    However,  if they were to try and claim that damage again(that they did not fix) on another claim - that would be insurance fraud.  

  5. They can do anything they want with the check.  Their car was damaged, they got paid.  They don't ever need to have the dent fixed if they so choose.  No fraud occurred.  Case closed

  6. It's not fraud. What they do with the money is of no concern of yours at all. Your insurer is only obligated to pay them for the loss -- they can fix the car, burn the check in the fireplace, buy crack, whatever.
