Question:

What could an individual do if he/she loses an appeal case in the second circuit court?

One of my friends has filed a petition for review based on the decision made by the Board of Immigration Appeals with the second circuit court. We are just wondering what can we expect if the motion to open case is denied by the panels? What sorts of actions can we take? What should we do next?

  1. If review is denied (they usually are), the case is for all practical purposes over and done with.  It is extremely difficult, and extremely costly to try to take a case to the Supreme Court.  And if a circuit court of appeals won't hear a case, the Supreme Court certainly won't.

    If this is a deportation case, stop fighting.  Do not waste your time and money.  All you are doing is making some shyster lawyer rich.  It is rarely worthwhile trying to take something from the Board of Immigration Appeals to a higher court.
