What could happen in this situation?

My mother is in a nursing home with End-Stage Dementia & delusions. She is being sued by a collection agency over a debt that was last paid around 4 yrs ago. (This is only the first in about $65,000 worth of debt.) The only money mom has is her retirement and SSI which I use to pay for her nursing home and med bills.

Can she have her retirement and SSI taken away by these people? All of these credit card company's gave her credit of around 10K each when she didn't even get $900 per month including SSI and now she has no recollection of ever having a credit card.

As far as I'm concerned, if they give a person credit who has no way of ever paying it back, they deserve to have the card go in default. I paid all of my debts and live debt-free, so don't think this is my way of life. Mom just went downhill fast with dementia (had it since at LEAST 1998) and only has a small amount of money to "live on" til she dies. Not trying to be crass, its just that it's the truth.

  1. You need to contact an attorney. The creditors might not even be able to collect on all/any of her income in your state.


  2. I'm not sure what they could do to her.  Does she have health insurance?  Are they aware of your mothers condition?  If so you could always sue them.

  3. You should pull all three of her credit reports.  Use this government recommended scam free site:

    If you find this on her reports, check out your states Statute of Limitations on credit collections here (if it's past the SOL, they can not garnish her SSI):

    If it is on her reports, next thing to do is dispute the living daylights out of it.

    DO NOT talk to these people.  Do not give them one single word of verification of any kind.  Refuse to talk to them until you figure out exactly what is going on.

    Everything you say will be used against you in a court of law, and that is no lie.

  6. I know you may not want to spend a lot of money on this, but I think a lot could be done with the assistance of a lawyer.  Perhaps a notarized letter from a doctor and the lawyer's "cease and desist" will be enough to keep the wolfs from your door.
